Litigation: Real Estate Litigation

At Caserta & Spiriti, we represent both plaintiffs and defendants in complex commercial and residential real estate litigation and fraudulent real estate practices.

We have substantial experience in a wide variety of litigation matters involving real estate development. We have handled real estate matters including entitlement disputes with municipalities; specific performance; claims of lenders and joint venture partners; disputes arising out of land sales transactions, financing arrangements and construction defects; disputes with homeowner associations; and broker claims.

We have successfully resolved, many diverse disputes arising out of real estate purchase agreements, including actions seeking money damages and actions to compel contract performance. We have litigated many disputes involving real property purchase options and leases in which control over real property was at stake. We have handled innumerable commercial lease disputes that have arisen in recent years.

Our real estate litigation attorneys also have extensive experience in leasing transactions, corporate facilities, financing and workouts and retail and restaurant transactions. Because many real estate agreements and commercial leases contain arbitration provisions, our real estate litigators are experienced in all aspects of alternative dispute resolution, including mediation and arbitration.
